Introduction and acceptance
These Terms and Conditions (“Terms”) govern your access to and use of the website at superiorgreenstonecl.ca (the “Website”) operated by Superior Greenstone Association for Community Living (“SGACL”, “we”, “us”, or “our”), including the purchase of tickets in our online 50/50 raffle.
By accessing the Website, purchasing a ticket, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Website. Your purchase of raffle tickets is also governed by our Raffle Rules of Play, which form part of these Terms.
Definitions
- “Raffle” means the online 50/50 raffle conducted by SGACL under AGCO Licence No. RAF1552567.
- “Ticket” means an entry in the Raffle purchased through the Website.
- “Draw” means the random selection of a winning ticket at the date and time published for each Raffle period.
- “User”, “you”, “your” means any person who accesses the Website or purchases a Ticket.
- “Content” means all text, images, logos, and other material made available on the Website.
Use of the website
You agree to use the Website lawfully and in accordance with these Terms. You must not:
- Use the Website in any way that breaches applicable laws or regulations;
- Attempt to gain unauthorized access to the Website, its servers, or any connected systems;
- Interfere with or disrupt the Website, including by introducing malware or excessive automated requests;
- Misrepresent your identity, age, or location; or
- Use the Website to collect information about other users without their consent.
We may suspend or terminate access to the Website for any User who breaches these Terms.
Eligibility
To purchase Tickets, you must be at least 18 years of age and physically located in the Province of Ontario at the time of purchase. We verify age and location as part of the purchase process, and we may refuse or cancel any Ticket purchased in breach of these eligibility requirements. It is your responsibility to ensure you are eligible before purchasing.
The 50/50 raffle
Our Raffle offers participants the chance to win 50% of the total ticket sales for each Raffle period, with the remaining 50% supporting SGACL’s charitable programs. All purchases are subject to the Raffle Rules of Play, which set out ticket pricing, draw procedures, prize claims, and eligibility in full. In the event of any conflict between these Terms and the Rules of Play concerning the Raffle, the Rules of Play prevail.
Employees and Board members
Members of the SGACL Board of Directors and staff who are directly involved in the conduct and management of the Raffle are not permitted to purchase Tickets. This restriction is also set out in the Raffle Rules of Play and may be verified during the prize-claim process.
Payments and payment processors
All payments for Tickets and donations are processed by trusted third-party payment processors, which may include Stripe, Square, or CanadaHelps. Your card details are entered directly into the processor’s secure, hosted payment form or iframe and are handled in accordance with the Payment Card Industry Data Security Standard (PCI-DSS).
SGACL does not collect, see, or store your full card number. By making a payment, you agree to the applicable payment processor’s terms in addition to these Terms. You confirm that you are authorized to use the payment method you provide.
Refunds policy
Because Tickets are entries in a licensed raffle, all sales are final and non-refundable once a Ticket has been issued, except where required by law or by the AGCO Rules of Play. If a transaction is charged in error, is duplicated, or a Raffle is cancelled by SGACL or the AGCO, we will refund the affected purchase to the original payment method. To request a refund in these circumstances, contact info@superiorgreenstonecl.ca with your transaction details.
Intellectual property
All Content on the Website, including the SGACL name, logo, text, graphics, and design, is owned by or licensed to SGACL and is protected by copyright and other intellectual-property laws. You may view and print Content for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from any Content without our prior written permission.
Third-party links
The Website may contain links to third-party websites and services, including our payment processors, raffle platform, and support resources such as ConnexOntario. These links are provided for convenience only. We do not control and are not responsible for the content, policies, or practices of third-party websites, and their inclusion does not imply endorsement.
Disclaimer of warranties
The Website and its Content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Website will be uninterrupted, error-free, secure, or free of harmful components, or that any information on it is complete or current.
Limitation of liability
To the fullest extent permitted by law, SGACL and its directors, officers, employees, and volunteers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or in connection with your use of the Website or participation in the Raffle. Nothing in these Terms limits any liability that cannot be excluded under applicable law.
Indemnity
You agree to indemnify and hold harmless SGACL and its directors, officers, employees, and volunteers from and against any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Website, or your violation of any law or the rights of a third party.
Privacy
Your use of the Website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information, and our Cookie Policy. Please review both documents to understand our practices.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Website after changes take effect constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You agree to submit to the exclusive jurisdiction of the courts of Ontario for the resolution of any dispute arising out of these Terms or your use of the Website.
